ADGM


The laws for Electronic Transactions may apply in the ADGM-free zone (Abu Dhabi Global Market). Currently, there is no certainty regarding electronic transaction laws so it is advisable to exercise caution before using electronic signatures. Equally, caution applies to the execution of any very valuable or crucial agreement for your company. Also, this applies if the agreements express recognition of the parties involved in the signing.


Eligibility Criteria and Process of an E-Signature Card UAE


You can purchase the e signature card from Tasheel by visiting their service centers. You can also request it through an electronic form from the companies that are subscribed. Additionally, the card is indicated if you are a business owner or an authorized signer, or any legal business representative.

You could apply for the DCSP license through the TDRA or Telecommunications and Digital Government Regulatory Authority. So, to work in the emirates, providers of the digital certificate solution, for records, signatures, and electronic documents concerning transactions, must have a TDRA license.


Therefore, to apply for the DECSP license, you must submit the following documents to TDRA:


  • ·      The incorporation records of your company.
  • ·      The articles of association.
  • ·      Information related to organizational structure and ownership of the company.
  • ·      The commercial license.
  • ·      Manifestation of commercial activities.
  • ·      All the details of the bank accounts of your company and financial resources. These will have to be from the last two years.
  • ·      The insurance policy with coverage suitable for your activities as DCSP.


ICA Service


The ICA or Federal Identity and Citizenship Authority has electronic signature and time stamp services. Therefore, with its services, you can sign documents or make digital transactions. This way, you will have a time stamp with the signature so you have an exact certification of when you made the signature.


To complete the process you will only need to present your UAE ID, that is valid for the parties involved. This way, no one will be able to change the timestamp under any circumstances even if you are the owner of the signature. Therefore, you will have pressure in creating and updating documents and transactions.
