What are the steps to request releasing of passport- #1 Guider

The passport releasing Dubai, after being held by the authorities, is possible depending on the circumstances. Thus, retention occurs if there is a criminal case pending against you, to prevent your departure from the country.

In this article, we can see what alternatives you have to resolve this situation or what you can do to get out temporarily. Let us see:

  1. When is a passport returned in the UAE?
  2. Connect Legal helps you resolve this situation

1. When is a passport returned in the UAE?

Generally, authorities seized a passport for specific reasons which, in most cases, are for criminal cases. In addition, for this type of non-serious case that has not been resolved, the passport of the guarantor of the defendant will be confiscated. In this case, if the accused person must leave the country, they can bring a guarantor person who will deliver his/her passport.

Otherwise, they will return the passport due to the invalidity of the case for which the authorities seized it. In addition, the authorities only seized these documents in valid criminal cases, with the intention that the person does not try to deter their criminal obligation. Mostly, the cause expires with the resolution, when they exonerate the crime, serve a sentence, pay a fine, or reach an agreement.

In this way, you will be able to present the necessary documentation for the passport releasing Dubai. Therefore, you should consider these issues if you need to leave the UAE and have a case pending in court.

1.1 Cases in which you could request the passport releasing Dubai

As we have pointed out, they seize your passport for ongoing investigation cases or in a court case of another person. Therefore, you will have to apply to releasing of your passport in a court in the United Arab Emirates. However, you can travel outside of the UAE when you find yourself in a non-serious police case where you usually only receive a fine.

However, the condition applies when you have to travel for an emergency and a judge accepts this reason. In addition, you can bring a person to serve as guarantor and to deliver his/her passport until your return. Moreover, the court ensures that the person presenting is responsible for collecting or delivering your passport.

Thus, the guarantor ensures your arrival, at the court or to the police, when you return to the country for the delivery of your passport. Otherwise, when authorities exonerate you from the charge, the guarantor can request the return of the passport. On the other hand, if the court found the accused person guilty, they can ask for a passport application after the court processes him/her.

1.2 Documents for the releasing of passport requests through the MOJ

Regardless of the type of case with which you present the passport, you must go to the relevant judicial authority. In this case, you can request the return of your document through the Ministry of Justice (MOJ) website. Thus, the website of the Ministry of Justice (moj.gov.ae) states that the applicant has to present a case registered with the office of the prosecutor in the UAE.

In addition, you must be present at the relevant court to collect your passport. Additionally, you must submit certain documentation along with the application for the passport releasing Dubai. The documents are the following:

-A detailed request for the release of the passport.

-Passport receipt from the judicial authority (only for guarantors).

–Emirates ID.

-Passport copy.

1.3 Steps to request releasing of passport

Follow the steps below to recover your passport in the UAE, in the event of a seizure:

-Go to the website of the Ministry of Justice and select “Start service”.

-Then, the website will redirect you to the office of the prosecutor, once in “Passport reception” click on the “Continue” button.

-Before proceeding, you must first create an online account with the UAE Public Ministry. Also, log in with your UAE Pass account and complete the setup by entering your date of birth.

-After you have access to the application form, fill in the following case information.

–Case number.

–Case year.

–Location.

–The name of the prosecution or court.

–Reserved place (Emirate).

-Select whether or not you are part of the case, and choose the final option in case you are a guarantor.

-When selecting not a party to the case, you must choose the relationship you have with the individual, for example, a lawyer or sponsor.

-Then, upload the required documentation and click “Submit”.

-Then pay the application fees, usually costing AED 20. Also, according to the Public Ministry, the process takes about 1 hour.

-After completing the steps, you must wait for the judge to approve or deny your request.

Likewise, when authorities approve the order to release the passport, go to the court with a copy of the decision to recover your passport.
