  3. If the verdict does not satisfy one of the parties, it may go to the Appeals Department.
  4. The Law Enforcement Department is in charge of enforcing the verdict in the above cases.

This government entity was established in 2013 as a judicial body of the Dubai Land Department (DLD). In addition, it was created to solve problems related to real estate in Dubai, impartially and transparently.

For this purpose, the rental dispute center has a specialized judicial system to resolve such situations. This guarantees the social and economic stability of the United Arab Emirates. Thus, the RDC is responsible for:

  • The resolution of rental disputes between tenants and owners in the Emirates and free zones. This includes counterclaims and requests for temporary or urgent action from those involved in the lease.
  • Resolve the appeals filed against the decisions and judgments issued by the entity.
  • Implement decisions and judgments issued after the settlement of a Dubai rental dispute.

  • Original and copy of the Emirates Identity Document.
  • Original and copy of the property title and passport of the landlord.
  • Latest DEWA bill.
  • Passport of the tenant.
  • Copy of the visa of the tenant.
  • Proof of rental deposit.
  • Copies of checks made to the landlord.
  • Proof of correspondence between each of the parts.

  1. The first step is to try to resolve the dispute through an amicable agreement between the parties involved. Thus, the first instance that takes the case is the Directorate of Mediation and Conciliation of the RDC. This department listens to the case and makes a conciliatory proposal.

In this scenario, the process can take up to 15 days, and in the case of agreement, it takes force from the execution order. On the contrary, if there is no solution, the case goes to a second instance.

  1. If there is no agreed solution, the case goes to the Trial Division. Once this division adjudicates the situation, it will proceed with the ruling on the corresponding ruling. However, there may be an appeal, except for claims on rentals whose value is less than AED 100,000.

In these cases, the sentence is final without the right to appeal.

  1. You can appeal a case within 15 days from the date of the judgment issued. In addition, you must deposit the amount of the judgment in the rental dispute centre until determined. However, the president of the government entity may decide to admit the appeal without this deposit.
  2. The last step is the final execution of the sentence issued by any of the instances, depending on the case. Next, an execution file will be opened against the person responsible for the crime. In this way, the executive bodies will begin to take the necessary measures according to the case.

5.1 What is the cost of filing a rental dispute in Dubai?

The Dubai rental dispute registration fee is 3.5% of the annual rent. Therefore, for these claims, the fee may be between AED 500 and AED 15,000. However, it can be extended up to AED 20,000 when we talk about eviction and AED 35,000 in case of financing and eviction.

In addition, other costs include:

  • The processing fee is AED 100.
  • The knowledge fee is AED 10.
  • The innovation fee is AED 10.

Other costs may include the following:

  • AED 105 per fast track notification as an innovation fee.
  • For the registration of power of attorney AED 25.

6. When can a landlord evict a tenant before the expiration of the lease? When must he notify the tenant of the reasons for the eviction?

The conditions for the landlord to request the eviction of the tenant at the expiration of the lease are:

  • The homeowner wants to renovate or destroy the property.
  • The property needs extensive maintenance and cannot be completed with the tenant on-site.
  • The owner of the property wants to sell it.

In any case, the owner must notify the opposing party 12 months in advance by mail or notary public.

7. What is the notice period if the tenant wants the home for personal use?

A property owner can evict a tenant if he wants the property for personal use. You can also do this if you want to give it to your first-degree relatives for their use. However, to avoid a rental dispute, you must serve a 12-month eviction notice through a notary.

This is determined by Article 25 of the Dubai Tenancy Law as amended.
