Immigrartion Lawyers in Dubai, Abu Dhabi, UAE
Several laws and regulations have been enacted to regulate the flow of foreigners entering and exiting the country’s territory. The Immigration Law [Federal Law No. 6 of 1973 as amended by Federal Law No. 13 of 1996] contains the laws governing immigration regarding the entry and residency of expatriates in the UAE.
Furthermore, the UAE government issues several immigration regulations through ministerial decrees and orders; the most important of which, in terms of procedure, is the Decree Ministerial Decree Number 360 of 1997 to Issue the Executive Bylaw of the Immigration Law.
Hence, to enter the country legally, an individual would need a valid visa. It is a permit to be stamped on a foreigner’s passport or travel permit, allowing him to enter the country. Unless the visa specifies the names of visa beneficiaries, it should be accompanied by all persons listed in the passport.
So, a visa enables entry into the UAE for short or temporary periods, some of which are renewable. The types of visas available before entering the country are listed below, according to Article 8 of the Immigration Law. So, that article states that “any entry permit or visa shall state the purpose of entry into the country.”
Types of Visas
- Tourist Visa.
- Transit Visa.
- Visit Visa.
- Multiple Entry Visa.
- Residence Visa.
- 96-hour Transit Visa.
- 14-transit visa.
- 60-day renewable visa.
Hence, the rule for foreign visitors entering the UAE is that all visitors require visas. And of course, there are exceptions. For instance, citizens of the GCC countries (Kuwait, Saudi Arabia, Bahrain, Oman, and the UAE). Also, the government exempts the following citizens:
- Hong Kong
- New Zealand
- People’s Republic of China
- San Marino
- South Korea
- The United Kingdom
- The United States of America
- Vatican City
What can those citizens do?
Citizens of the aforementioned countries do not require a visa to enter the UAE. For a fee of AED 100, such visitors can obtain permits at the airport. It allows visitors to stay in the country for up to 60 days. Additionally, they would have the option of extending their stay for an additional 30 days.
Extensions may be available through the Naturalization and Residency Department. The fee for an extension is AED 500, and it must be submitted within 60 days of the trip. Importantly, to apply for any visa or permit, you must be sponsored by a UAE resident or another legal entity; for example, a corporation (employer) or a hotel.
So, if a hotel or a UAE resident is sponsoring the visa or permit, they will usually deposit the visa at the airport. So, the permission can be collected upon arrival. Hence, the UAE bodies responsible for issuing visas and permits to foreigners wishing to enter the UAE are:
- The Naturalization and Immigration Administration.
- The International Airport Authority of any member emirate.
- And any other institute selected by the Ministry of Interior.
Entry permits are not the same as visas, and they can only be obtained within the UAE at the Immigration and Residence Headquarters. So, the types of grants available to foreigners to stay legally in the UAE are listed below:
- Employment Permit.
- Residence Permit.
- Residence for Employees Permit
- And Residence with Work Permit.
96-hour Transit Visa
According to Article 7 of the Immigration Law, the Immigration authorities in any member emirate in the UAE may act by rules set by the Ministry of Interior grant aliens entry to the country visas for ninety-six (96) hours as per the following conditions:
- The foreigner must have a passport or a travel permit that is valid for entry into both the country of origin and the country of destination.
- He should be able to continue his journey if he has a ticket.
- He must leave the country within ninety-six (96) hours of receiving the visa.
According to Article (12) of the Immigration Law, any outsider entering the country with a visit visa or authorization should leave the country on the expiry date of such visa; or consent, either through cancellation or expiry period thereof. Unless he has obtained a habitation permit.
Hence, a visit visa can be obtained by an outsider for a variety of reasons. Even though systems are generally the same for everyone, conditions vary depending on who the guest is and who the guest’s support is. The following are the legally permissible reasons for entering the UAE on a visit visa:
- To pay a visit to family or friends who live in the UAE.
- To attend to a legal person.
- For tourism.
Thus, if a tourist stays in the country after the legal period has expired, he is fined AED 100 per day; plus, an additional AED 100 for airport documentation processing fees. So, if a person obtains a visit visa, he must travel within 60 days of the visa’s issuance date. Otherwise, the permission must be renewed, and a fee of AED 150 is required.
As stated in Article 11 of the Immigration Law, visitors on a visit visa are not permitted to work. Hence, an outsider who obtains a visit visa cannot work in the country, either for pay or on his own. If the visa is for work for an individual or a foundation, the holder may not work for another individual or foundation without written permission from that individual or foundation and approval from the Directorate of Nationality and Immigration.
Multiple Entry Visa
Residents of the following countries can obtain a 90-day various section visit visa that is valid for a half year from the date of issue for a stay of 90 days.
